1. Agreement to Terms

Your access to and use of the Bifit mobile application and related services (collectively, the "Service") is conditioned upon your acceptance of these Terms and Conditions ("Terms") and the Bifit Privacy Policy. By accessing or using the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must discontinue use of the Service.

2. Eligibility

You represent and warrant that you are at least 13 years old. If you are between 13 and 17 years old, you may only use the Service with the consent and supervision of a parent or legal guardian, who agrees to be fully responsible for all activities conducted using the Service.

3. Description of Service

Bifit is a fitness tracking application that allows users to track workouts and exercises, create and follow training programs, calculate fitness metrics and power scores, track body measurements and progress, use AI-powered features for workout generation, diet planning, and calorie estimation, connect with other users through social features, and work with fitness coaches.

4. Account Registration

• You must provide accurate and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.

5. Health, Fitness, and Safety Disclaimer

Bifit does not provide medical advice, nutritional counseling, or professional health services. All workout programs, diet plans, calorie estimates, and fitness metrics are automated approximations and may be incomplete or inaccurate.

• Calorie and nutrition estimates are approximations only.
• AI-generated workout programs and diet plans are for informational purposes only.
• The Service is not intended to diagnose, treat, cure, or prevent any disease.
• You should consult licensed professionals for dietary, medical, or fitness guidance.
• You use the Service and follow any suggestions at your own risk.
• The Company is not liable for any injuries, health issues, or adverse effects resulting from the use of information provided through the Service.

6. Coaching Services and Disclaimer

Bifit is a platform that connects independent coaches/trainers with clients. Coaching content is provided by the respective coach; Bifit is not responsible for its accuracy, suitability, or outcomes.

• Coaches are not employees or agents of Bifit; they are independent third parties.
• Training and nutrition programs offered by coaches are for general informational purposes and do not replace individual medical advice.
• Coaches providing nutrition/diet consulting are required to declare relevant certifications or credentials; however, Bifit does not guarantee the validity of these documents, and ultimate responsibility for verification rests with the user.
• If you have a health condition, allergy, pregnancy, or chronic illness, you should consult a physician or qualified health professional before starting any program.
• The relationship between a coach and a client is between those parties; Bifit cannot be held liable for disputes, damages, or obligations arising from that relationship.
• Bifit does not charge any commission or fee from the coach-client relationship and is not a party to any payment between them. All payment arrangements for coaching services take place between the parties, outside the platform.

7. Subscription, Billing, and Payments

6.1 Free and Paid Features

Bifit offers both free and premium features. Some features require an active subscription (Bifit Pro or Bifit Premium).

6.2 Billing

Purchases and subscriptions are processed through the Apple App Store and Google Play Store. Their terms govern payment processing, renewals, and refunds. Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends.

6.3 Cancellation and Refunds

• You can cancel your subscription at any time through your device's subscription settings.
• Cancellation takes effect at the end of the current billing period.
• Refunds are handled by Apple or Google according to their respective refund policies.

6.4 AI Feature Limits

AI-powered features are subject to daily usage limits to ensure fair use. We reserve the right to modify usage limits and features at any time.

8. User Content; License Grant

By submitting User Content (photos, workout data, comments, or other inputs), you represent that you own or have rights to it. You grant the Company a worldwide, royalty-free, sublicensable license to use, store, process, reproduce, and display your content solely to operate, maintain, and improve the Service.

You agree not to upload or share content that:

• Is illegal, harmful, threatening, abusive, harassing, or defamatory
• Contains nudity, sexually explicit material, or graphic violence
• Infringes on intellectual property rights of others
• Contains spam, advertising, or promotional material
• Impersonates another person or entity

9. Prohibited Uses

• Reverse engineering, decompiling, or disassembling the Service
• Using automated tools, bots, or scrapers to access the Service
• Attempting unauthorized access to other users' accounts or our systems
• Interfering with or disrupting the Service's operation
• Circumventing any usage limits or restrictions
• Using the Service to harass, bully, or intimidate other users
• Creating multiple accounts for abusive purposes

10. Termination

The Company may suspend or terminate your access at any time if you violate these Terms. Upon termination, all rights granted to you immediately cease. You may delete your own account at any time through the App settings or at bifit.app/delete-account. Upon account deletion, your data will be permanently removed as described in our Privacy Policy.

11. Intellectual Property

All rights in the Service (excluding User Content) are owned exclusively by the Company or its licensors, including design, features, code, graphics, logos, and content. You may not copy, modify, distribute, sell, or create derivative works based on any part of the Service without our prior written consent.

12. Third-Party Services

The Service may include links or integrations with third-party content or services. The Company does not control and is not responsible for such services. Their terms and privacy policies govern your use of those services.

13. "AS IS" and "AS AVAILABLE" Disclaimer

THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THE COMPANY DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM. THE COMPANY IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PERSONAL INJURY, OR HEALTH ISSUES ARISING FROM YOUR USE OF THE SERVICE.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from these Terms shall be resolved in the courts of Istanbul, Turkey.

16. Severability and Waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Failure to enforce any right or provision does not constitute a waiver of that right.

17. Changes to These Terms

We may update these Terms at any time. Material changes will be announced through the App or by other reasonable notice. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Service and delete your account.
